I figli trascorrono le vacanze con me: posso non pagare l’assegno di mantenimento ad agosto? La risposta è no: salvo accordi o provvedimenti diversi, il mantenimento non può essere sospeso o ridotto unilateralmente. L’assegno non è il rimborso delle sole spese sostenute durante quel mese. Contribuisce ai bisogni annuali dei figli, molti dei quali continuano anche quando sono in vacanza. E per alberghi, centri estivi, campus e soggiorni studio? DIVORZIO INTERNAZIONALE E GIURISDIZIONE INGLESE: quale giudice deciderà sul patrimonio familiare? Nella mia recente intervista a Forbes Italia approfondisco uno dei temi più strategici del diritto di famiglia internazionale: la giurisdizione nei procedimenti di separazione e divorzio tra Italia e Inghilterra. Quando una coppia ha residenze, cittadinanze, immobili, società o interessi economici in più Paesi, la scelta del foro non è un dettaglio tecnico. Può incidere sulla tutela del patrimonio, sul mantenimento, sulle partecipazioni societarie e sugli accordi matrimoniali. La giurisdizione di Inghilterra e Galles assume particolare rilievo nei divorzi che coinvolgono High Net Worth e Ultra High Net Worth individuals, imprenditori, manager, famiglie internazionali e patrimoni complessi. Il sistema inglese dei financial remedies attribuisce al giudice ampi poteri nella ricerca di una soluzione equa. Per questo, il regime di separazione dei beni scelto in Italia non produce necessariamente, davanti a un tribunale inglese, gli stessi effetti che avrebbe nel nostro ordinamento. La prima domanda, quindi, non è soltanto: “Come sarà diviso il patrimonio?” Ma soprattutto: “Quale giudice ha giurisdizione e quale legge potrà incidere sulle conseguenze economiche del divorzio?” Nei procedimenti internazionali, residenza abituale, collegamenti territoriali, tempi e strategia processuale possono cambiare l’esito della controversia. Un’analisi preventiva è essenziale soprattutto in presenza di immobili in più Stati, aziende, trust, investimenti, stock option, carried interest o strutture di family office. International divorce is never just about divorce. I am honoured to have been featured by @spearsmagazine in its article: “Divorce, Italian style: As HNWs flock to Italy, so are family law firms.” The growing presence of high-net-worth and ultra-high-net-worth families in Italy is changing the landscape of international family law. Cross-border divorce cases may involve multiple jurisdictions, family businesses, trusts, real estate, tax residence, succession planning, reputational interests and the protection of children. In this context, the choice of jurisdiction can significantly affect financial claims, asset division and the recognition of marital agreements. Italy is attracting more and more international millionaires. But when wealth crosses borders, family law becomes global. According to Repubblica Finanza / Teleborsa, around 3,600 millionaires chose Italy in 2025, bringing with them an estimated $21 billion in wealth. This is not only an economic trend. It is also a legal challenge. When families live between different countries, everything becomes more complex: marriage, separation, divorce, children, assets, family businesses, trusts, tax residency and inheritance. Even a simple choice — such as the matrimonial property regime — can have very different consequences depending on the country involved. In Italy, couples may choose between separation of assets and community of assets. But in common law jurisdictions, these concepts may be interpreted differently. And in an international family crisis, this can make all the difference. For global families, legal planning is essential. It is no longer enough to ask: “Where do we live?” We must also ask: “Which law applies?” “Which court has jurisdiction?” “How can children and assets be protected?” “How can long and expensive disputes be avoided?” The future of family law is international.
